MSA Determination definition

MSA Determination means the Commission Determination on the Mandatory Standard on Access, Determination No 3 of 2016 which came into operation on 1 January 2017 and any subsequent amendments thereto.
MSA Determination means the Commission Determination on the Mandatory Standard on Access, Determination No 2 of 2005 which came into operation on 1 July, 2005 and the Variation to Commission Determination on Mandatory Standard on Access (Determination No. 2 of 2005), Determination No. 2 of 2009 which came into operation on 2 February, 2009 and any subsequent amendments thereto.
MSA Determination means the Commission Determination on the Mandatory Standard on Access, Determination No 1 of 2022 which came into operation on 1 November 2022 and any subsequent amendments thereto.

Examples of MSA Determination in a sentence

  • The Access Provider must use its reasonable efforts to accept and fulfil Orders from the Access Seeker for Facilities and/or Services which comply with a Forecast accepted by the Access Provider pursuant to subsection 5.6 of the MSA Determination (MSA 5.7.11).

  • For purpose of determining technical infeasibility in Clause 5(n)(iii), the Operators shall comply with subsection 5.4.17 of the MSA Determination.

  • The Operators shall recognize and act consistently with the Customer relationship principles set out in subsection 4.3.2 of the MSA Determination.

  • Once an Access Seeker confirms a Forecast, it is deemed to be an Order for the purposes of the MSA Determination and this RAO and subsection 5.7 of the MSA Determination and Clause 7 hereof will apply (MSA 5.6.3).

  • For purpose of determining capacity constraints in Clause 5(n)(iv), the Operators shall comply with subsection 5.4.18 of the MSA Determination.

  • The Commission has issued the MSA Determination and this RAO is prepared in compliance to subsection 5.3.3 of the MSA Determination.

  • If the Access Provider refuses an Access Request, it must notify the Commission within five (5) Business Days of that refusal together with an explanation of its reason for refusal under Clause 5(m) or 5(n) hereof and subsection 5.4.11 of the MSA Determination (MSA 5.4.19).

  • The Operators may agree to an alternative forecasting procedure other than that set out in subsection 5.6 of the MSA Determination or to dispense with such procedure altogether.

  • However, nothing in the MSA Determination shall limit the Access Seeker’s ability to freely request and agree on access to the Access Provider’s Facilities and/or Services that is either superior or inferior (in terms of technical standard and quality) to that which an Access Provider provides to itself (MSA 4.2.2).

  • The utility and ancillary costs in respect of the network facilities provided by the Access Provider to the Access Seeker as contemplated in subsection 6.8.12 of the MSA Determination and item (12) above shall be apportioned (in accordance with fair and equitable principles) between the Access Provider and all Users at the relevant location.

  • Claim Determination Period means a calendar year. However, it does not include any part of a year during which a person has no coverage under This Plan, or any part of a year before the date this COB provision or a similar provision takes effect.

  • Final Determination means the final resolution of liability for any Tax for any taxable period, by or as a result of (a) a final decision, judgment, decree or other order by any court of competent jurisdiction that can no longer be appealed, (b) a final settlement with the IRS, a closing agreement or accepted offer in compromise under Sections 7121 or 7122 of the Code, or a comparable agreement under the Laws of other jurisdictions, which resolves the entire Tax liability for any taxable period, (c) any allowance of a refund or credit in respect of an overpayment of Tax, but only after the expiration of all periods during which such refund or credit may be recovered by the jurisdiction imposing the Tax, or (d) any other final resolution, including by reason of the expiration of the applicable statute of limitations or the execution of a pre-filing agreement with the IRS or other Taxing Authority.

  • Adverse determination shall have the meaning set forth in Section 19.7.
