  • During the performance of this MSA, Contractor will not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, age, disability, or other basis prohibited by state law relating to discrimination in employment, except where there is a bona fide occupational qualification reasonably necessary to the normal operation of Contractor.

  • Except where expressly permitted under this MSA, Contractor shall not make part delivery of the Goods.

  • Within [thirty (30)] days from the end of each calendar month following commencement of the Work (the "month in question") or, in the case of a lump sum payment, such other invoice period as set out in this MSA, Contractor shall submit to Company a single invoice for the value ascertained in accordance with this MSA for the Work completed in accordance with the provisions of this MSA during the month in question or, in the case of a lump sum payment, during such other invoice period.

  • In connection with this MSA, Contractor shall, and shall procure that the other members of Contractor Group shall, strictly observe and comply with all Legislation and not carry out or permit any act or omission which would result in a breach of or non-compliance with Legislation.

  • Except as otherwise set out in this MSA, Contractor shall provide all consumables required for the Equipment and shall maintain a full stock of manufacturer recommended spare parts and associated tools and equipment which shall at all times be readily available, and where required, shall be provided and used by Contractor in order to keep the Equipment in full operational service for the duration of this MSA.

  • Where required under this MSA, Contractor shall provide maintenance services for the Equipment in respect of which Contractor shall provide Company with an outline maintenance programme.

  • Where Company or any of its authorised representatives require the permission of any member of Contractor Group to access any Worksite, including in respect of any inspection, testing, witnessing, expediting, monitoring or examination required under MSA, Contractor shall permit or procure such access and provide or procure all facilities and assistance as may be required in connection therewith.
