The M&R Index will be prepared annually during the Construction Period and the M&R Period on a calendar year basis by the Province for the purposes of the DBFM Agreement.
In the event that any of the indices or data used in the calculation of the M&R Index becomes unavailable or inapplicable during the Construction Period or the M&R Period, the Province shall, in consultation with the building maintenance industry and the Contractor, substitute reasonable alternative indices or data.
The Contractor acknowledges that the Province may, during the School M&R Period and the M&R Period, delegate to each School Board the rights and responsibilities of the Province under certain provisions of this Agreement (except the Province’s obligations to pay the Contractor pursuant to the terms of this Agreement) as set forth in the Tri-Party Agreement with each School Board, and that the Province may from time to time, with notice to the Contractor, amend the terms of such delegation.
In the event of a death involving employees of the Contractor or its subcontractors during the Construction Period or the M&R Period, the Contractor shall inform the Province within two hours of such a death.
The School Board and the Contractor each for themselves agree with the Province that they shall update each School’s emergency response plan and safety plan not later than October 1 of each year during the M&R Period.
For the duration of the Construction Period and the M&R Period, the Contractor shall conduct safety meetings prior to the commencement of any work on each major work phase of the Project and the M&R, or monthly, whichever occurs more frequently.
Not later than five Business Days before the end of each month of the M&R Period, the Contractor shall submit to the Province its Payment Calculation, in the form as is set out in Appendix 2.
In the event of an injury or accident as defined by Occupational Health and Safety Act regulations, involving employees of the Contractor or its subcontractors during the Construction Period or the M&R Period, the Contractor shall conduct an accident investigation in accordance with section 18 of the Occupational Health and Safety Act (or such successor section or legislation).
Notwithstanding Section 11.1(a), the Contractor shall not be obligated during the School M&R Period or the M&R Period to maintain insurance against a risk that has become uninsurable.
The School Board agrees with the Province that, during the M&R Period, the School Board will participate in meetings with the Contractor and the Province, established by the Contractor under its Collaboration Plan, to collaborate on and discuss M&R performance issues, custodial services, general communication of the parties, and any other matters arising in connection with the cleaning, maintenance, repairs and renewal of the Schools.
