Monthly Availability Plan definition

Monthly Availability Plan has the meaning assigned to such term in Section 6.2(a).

Examples of Monthly Availability Plan in a sentence

  • With respect to nominations of Gas during the Commercial Operation Delay Period, Purchaser may make nominations for Scheduled Gas in an amount up to the Baseload Quantity on any Day during the Commercial Operation Delay Period, notwithstanding the fact that the quantity of Gas available from the Facility on such Day specified in the applicable Monthly Availability Plan or Daily Availability Schedule may be none, but otherwise in accordance with Article VI.

  • Each Monthly Availability Plan shall also specify the quantity of Make-Up Gas (if any) that Seller will make available to Purchaser on each Day of the next Month, which shall be the same amount, not subject to Day-to-Day variation, on each such Day.

  • Purchaser shall notify Seller of whether it will exercise its option set forth in Section 4.1(b) to purchase an additional quantity of Make-Up Gas by the earlier of (i) 2:00 p.m. EPT on the sixth (6th) Business Day preceding the first Day of the next preceeding or next following Month of the Delivery Term, and (ii) twenty-four (24) hours after receipt of Seller’s Monthly Availability Plan.

  • Consistent with the basis for the establishment of the Monthly Availability Plan, and the commitment that Gas be made available to Purchaser at all times during the Term, Seller may not operate the Facility during periods where the Monthly Availability Plan has indicated that the Facility will be unavailable.

  • The Monthly Availability Plan may identify certain volumes as part of the Monthly Baseload Quantity and may identify certain volumes as part of the Daily Firm Quantity for the same Month.

  • The Monthly Availability Plan shall be communicated to Purchaser by written notice not later than 9:00 a.m. Eastern Prevailing Time on the sixth (6th) Business Day preceding the first Day of the Month for which such nomination applies and include volumes designated as Monthly Baseload Quantity or Seller’s anticipated Daily Firm Quantity.

  • On each Day of the Month in which a Daily Firm Quantity has been designated in the Monthly Availability Plan, Seller will also advise Purchaser on a Daily basis of the continued availability of the Daily Firm Quantity, if any, that Seller will make available to Purchaser for an upcoming Day of such Month.

  • However, where no Monthly Baseload Quantity is identified in the Monthly Availability Plan, Seller and Purchaser shall nevertheless observe the nomination protocols set forth in Section 6.2(d) relating to the Daily Firm Quantity.
