The Monitoring Facility reserves the right to verify all alarm signals by telephone or otherwise before notifying emergency personnel and may discontinue any particular response service due to governmental or insurance requirements by giving notice in writing to Client.
Subscriber acknowledges that if the signals transmitted from the Premises will be monitored in any Monitoring Facility not operated by AIS, that personnel in such Monitoring Facilities are not the agents of AIS, nor does AIS assume any responsibility for the manner in which such signals are monitored, or the response to such signal.

Upon receipt of any types of alarm signals other than as set forth above, the Monitoring Facility shall, subject to its current policies and procedures for two-call telephone verification, make every reasonable effort to notify the appropriate police or fire department and Customer (in accordance with Section 1.3(ii) hereof), unless there is reasonable cause to assume that an emergency condition does not exist.
If the signals transmitted from the Monitored Systems will be monitored in police, fire, or municipal departments, TE agrees to provide and maintain, or cause to be provided and maintained, a remote monitoring facility consisting of signal receiving equipment at such Monitoring Facility.
Customer acknowledges that a digital communicator will be utilized for the purposes of transmitting all signals from the Monitored Systems to the Monitoring Facility.
It is the Customer’s responsibility to check and test the PERS Equipment and other devices in the manner set out in the User Manual on a regular basis to ensure that signals are being received by the Central Monitoring Facility.
The Monitoring Facility shall respond to all other signals in accordance with its current operating procedures for responding to such signals.
The Monitoring Facility and its location are subject to approval by the Administrator.
While accessing the Monitoring Facility located on KLN’s property, City employees, agents and contractors shall observe all safety rules applicable to such premises, and the City shall defend, indemnify and hold KLN harmless for all harm, injury or death to persons or damage to property (“Loss”) arising out of City’s employees, agents and contractors activities at the Joint Monitoring Station, except for Loss caused by the negligence or other fault of KLN.
