The amount of insurance as required in the MOD Manual or as contained in any of the policies shall not be construed to be a limitation of liability on the part of Franchisee.
A copy of the MOD Manual must be securely and confidentially kept at the Franchised Restaurant at all times and all changes or additions to it must be inserted upon receipt.
The MOD Manual shall at all times remain the sole property of Franchisor and shall at all times be kept in a secure place on the Restaurant premises.

Prior to the opening of the Restaurant, the Operating Principal or Operating Designee and at least two (2) of Franchisee's managers (up to a maximum of 4 managers) shall attend and complete, to Franchisor's satisfaction, the initial training program conducted by Franchisor and/or employees of Franchisee who have satisfied the initial training program criteria set forth in the MOD Manual.
The Confidential Manual of Operating Data shall consist of a Food & Beverage Manual, Operations Manual, Managers' Training Manual, Employee and Management Training Guide, and an Equipment and Design Specifications Book (collectively the "MOD Manual").
Franchisee, the Operating Principal, the Operating Designee, and Franchisee's Principals shall at all times treat the MOD Manual, any other manuals created for or approved for use in the operation of the franchised business, and the information contained therein, as confidential, and shall use all reasonable efforts to maintain such information as secret and confidential.
The entire Franchised Restaurant must be open for business daily for such hours and days as BKE may from time to time specify in the MOD Manual or otherwise, unless and to the extent otherwise prohibited by applicable law.
Any person subsequently employed by Franchisee in the position of manager and each subsequent Operating Principal or Operating Designee, if any, shall attend and complete, to Franchisor's satisfaction, an initial training program satisfying the criteria set forth in the MOD Manual; and Franchisee shall pay to Franchisor a training fee at the then- current rate being charged by Franchisor to franchisees for such training.
