Such messages together with the sending and marketing of them are governed by PHONEPAYPLUS; “Qualifying Services” those Services provided by SMS EXPERT to the Customer as detailed in any Appendices to this Agreement or any Addendums to this Agreement on which commission is payable to the Affiliate pursuant to this Agreement; “Reseller” a Customer that resells the Services of SMS EXPERT; “Referral” a Customer who visits SMS EXPERT’s Websites for the first time as a direct result of having followed the Link from the Affiliate’s Website; “Distance Selling Regulations” means the Consumer Protection (Distance Selling) Regulations 2000;
