Employees are responsible for the full health insurance premium payment when on leave of absence without pay, unless federal or state law (FMLA and MMLA) requires otherwise.
Upon receipt of at least two (2) weeks' written notice of her anticipated date of departure and intention to return, the Superintendent shall grant a leave of absence for up to twelve (12) weeks in accordance with the provisions of General Laws Chapter 149, Section 105D, the Massachusetts Maternity Leave Act (MMLA), and the Federal Family and Medical Leave Act (FMLA).
Nothing in this section of the bargaining agreement shall be construed to affect the Committee’s requirement to abide by the MMLA, nor is it intended to expand or contract the rights and benefits of the act.
The leave may not exceed the balance of the year in which the original leave (including FMLA or MMLA) commences, plus one full academic year.
With the approval of the Superintendent, an employee may take an unpaid child rearing leave to extend beyond FMLA or MMLA leave.
Under this Section of this Agreement, the unpaid MMLA leave is up to a maximum of twelve (12) weeks.
Under this Section of this Agreement, an employee is eligible to apply for up to ten (10) consecutive days of available paid sick leave beginning immediately following the birth of a child or the adoption/▇▇▇▇▇▇ placement during an unpaid MMLA leave.
Nothing in this Section of this Agreement is intended to restrict an employee’s benefits under the Massachusetts Maternity Leave Act, nor is intended to expand the benefits under the MMLA, except as stated in this Section of this Agreement or under another provision of this Agreement.

Health insurance benefits are maintained throughout an MMLA and/or FMLA leave.
