Misselling definition

Misselling means any act or omission of the Transferor, any member of the Transferor Group or any of their respective directors, officers, consultants, employees, agents or appointed representatives (within the meaning of section 39(2) of the FSMA) in connection with the sale, marketing, promotion, distribution, arrangement or provision of any Transferred Policies which was in contravention of any laws, regulations and/or requirements of any court, governmental body or Regulatory Authority (including any guidance, direction, undertaking or written requirement of any such Regulatory Authority)

Examples of Misselling in a sentence

  • A Direct Seller will also not indulge in any deceptive or unlawful trade practices such as Mis-selling or Unfair Trade Practices as mentioned in clauses 3(f, g, and i) as defined in the Rules and Clause 2(1), (18), (20) (41) to 4(43) and (47) of the Consumer Protection Act, 2019 and if does so then he / she shall be only and solely responsible for the consequences and perils thereof.

  • Where We believe that poten�al Mis-selling has occurred to You, We will submit a detailed Claim to the Company and/or the Court upon Your Instruc�ons.

  • Mis-selling claims are claims from clients who allege that they have received misleading advice or other information from either the Issuer's internal, affiliated or external advisors (even though the Issuer does not always have full control over the affiliated or external advisors).
