Misplaced definition

Misplaced means any more than its common definition – that is, that the appellant simply put his paperwork in the wrong place. A person exercising "due diligence" would not have filed his NOA late simply because he "misplaced" his paperwork. The appellant, in his statement, implies that the hurricane damage to his home may have resulted in items being stored in boxes. However, he offers no explanation for how his paperwork was misplaced or where it was misplaced. Without any evidence directly attributing his untimely appeal to the hurricane, we will not equitably toll the 120 day judicial-appeal period simply because the appellant misplaced his paperwork.
Misplaced means incorrectly positioned. ‘Prediction’ means a thing predicted; a forecast.

  • Misplaced and lost items are kept in one location at each school.

  • For instance: • Dirty dishes and unemptied dishwasher • ▇▇▇▇▇▇▇ not removed from the property and disposed of in the outside bins • Soiled or stained bed covers, rugs, upholstery etcetera • Lost or damaged remote controls • Misplaced keys • Excessive handprints and or marks on walls/glass Please do not wash and towels or linen, as our cleaners will remove these items from the property when they clean.

  • If found, the Misplaced Note Holder agrees to promptly pledge, or cause to be pledged, the Misplaced Notes in favor of Agent, for the benefit of Lenders, as required under the Pledge Agreement.

  • Create or suffer to exist any Lien upon or with respect to any of the Misplaced Notes except for the Lien created by the Loan Documents.

  • As of the Closing Date, the Misplaced Notes are lost, destroyed or misplaced through inadvertence or otherwise and after conducting a diligent search of its records, no Credit Party has been able to locate the Misplaced Notes.

  • Misplaced, damaged or vandalised diaries will need to be replaced at the family’s expense.

  • If found, the Misplaced Note Holder agrees to promptly pledge, or cause to be pledged, the Misplaced Notes in favor of the Collateral Agent, for the benefit of Lenders, as required under the Pledge Agreement.

  • As of the Effective Date, the Misplaced Notes are lost, destroyed or misplaced through inadvertence or otherwise and after conducting a diligent search of its records, no Loan Party has been able to locate the Misplaced Notes.

  • During such time period, each party and its Affiliates shall comply with all applicable covenants and obligations with respect to any such Misplaced Assets held by it, including the payment of any costs and expenses in connection therewith, which shall be performed by such party or its applicable Affiliate for the other party’s account and such other party shall promptly reimburse such party for any such out-of-pocket costs, expenses or payments in respect thereto.

  • If any Misplaced Asset cannot effectively be assigned or transferred without first obtaining a consent or waiver from a third person or except by agreements of novation, the Actual Asset Holder shall (upon request of the Intended Holder) take all reasonable steps to procure that any necessary consent or waiver is obtained or any agreement of novation is entered into, and the Intended Holder shall cooperate with the Actual Asset Holder and any of its Subsidiaries for such purpose.

  • Tampering means inactivation, adjustment or modification of the emission control system, including any software or other logical control elements of such a system, that has the effect, whether intended or not, of worsening the emissions performance of the engine;
