Miscellaneous Requirements. A. To comply with Texas Health and Safety Code, §85.113 and §85.115 concerning workplace and confidentiality guidelines for persons with AIDS or HIV. B. To comply with applicable provisions of the Clean Air Act (42 U.S.C. §7401-7671q) and the Federal Water Pollution Control Act (33 U.S.C. §1251-1387), if funding for the Contract exceeds $100,000. C. That in accordance with §2155.4441, Texas Government Code, the Contractor shall, in performing any service under this Contract, purchase products and materials produced in Texas when they are available at a comparable price and in a comparable period to products and materials produced outside of Texas. D. To make a good faith effort to utilize historically underutilized businesses ("HUBs") when subcontracting. Some methods for locating HUBs include using searchable HUB databases at the Texas Comptroller of Public Accounts' website, using websites or other minority/women directory listings maintained by local ▇▇▇▇▇▇▇▇ of commerce, advertising subcontract work in local minority publications or contacting HHSC for assistance in locating available HUBs. E. That except as provided in the paragraphs below, the Contractor must not use HHSC's name, the State of Texas or refer to HHSC or the State directly or indirectly in any media release, public announcement, or public disclosure relating to this Contract or its subject matter, including, but not limited to, in any promotional or marketing materials, customer lists or business presentations (other than those submitted to HHSC, an administrative agency of the State of Texas, or a governmental agency or unit of another state or the Federal Government). The Contractor may publish, at its sole expense, results of Contractor performance under this Contract with HHSC's prior review and approval, which HHSC may exercise at its sole discretion. Any publication (written, visual, or sound) will acknowledge the support received from HHSC and any Federal agency, as appropriate. The Contractor will provide HHSC at least 3 copies of such publication prior to public release. The Contractor will provide additional copies at the request of HHSC. The Contractor may include information concerning this Contract's terms, subject matter, and estimated value in any report to a governmental body to which the law requires the Contractor to report such information. The Contractor must not use HHSC’s logo under any circumstances.

Miscellaneous Requirements. Engineer shall furnish, upon request by City electronic files in .pdf format (one formatted to 34”x22” full scaled and one formatted to 11”x17” half scaled) of the final approved “Bid Set”, sealed and dated. Engineer shall also submit an electronic file of the “Bid Set” drawings in .dwg format. In performing the services outlined above, Engineer will protect City to the extent reasonably possible against defects and deficiencies in the work of contractors. Engineer will report any observed deficiencies to City and Engineer will take any other appropriate actions; however, it is understood that Engineer does not guarantee the contractor’s performance, nor is Engineer responsible for supervision of the contractor’s operation and employees except to the extent defects, omissions or negligence is reasonably discoverable by Engineer. Engineer shall not be responsible for the means, methods, techniques, sequences or procedures of construction selected by the contractor, or the safety precautions and programs incident to the work of the contractor.

Assist City in the opening and tabulation of bids. 3. Engineer will review and approve (or take appropriate action with respect to) shop drawings, samples and other data which contractor(s) are required to submit. 4. In performing the services outlined above, Engineer will protect City to the extent reasonably possible against defects and deficiencies in the work of contractors. Engineer will report any observed deficiencies to City and Engineer will take any other appropriate actions; however, it is understood that Engineer does not guarantee the contractor’s performance, nor is Engineer responsible for supervision of the contractor’s operation and employees except to the extent defects, omissions or negligence is reasonably discoverable by Engineer. Miscellaneous Requirements. The Developer shall: 1. Easements: Provide any easements on Developer's land deemed necessary by the Public Works Director or his designee prior to accepting any public improvements and prior to any occupancy being grated for the use of the building.
Miscellaneous Requirements a) Assured grounding and Ground Fault Circuit Interrupters (GFCI) are required on all electrical equipment and electrical tools and must be furnished by Seller. If in doubt, ask the project supervisors or safety coordinator at the Site. b) Seller must use hot work, confined space, and line breaking permits required by BE&K or the client/owner. c) Scaffolding will be inspected by qualified persons and tagged with BE&K or similar tags approved by the BE&K safety coordinator. If Seller erects scaffolds, it must have a competent person assigned. d) Lifts over 2,000 pounds require completion of the BE&K pre-lift checklist form (Volume Two, Safety and Health Procedures Manual, Form 40-06-1). Lifts over 6,000 pounds require the approval of a BE&K rigging superintendent designated by BE&K. e) Seller must supply lockout locks for employees. These locks must not be used for other purposes and supervisors must ensure keys are controlled. f) Compressed air hoses and couplings must be inspected daily before use. All hose couplings must have positive locking devices. Chicago-type fittings must be secured with wire or clips. g) Electrical cords, hoses, and welding leads must be routed overhead when feasible, so as to avoid tripping hazards and damage to the cords, hoses and leads. Hoses, cords and leads routed on the ground will be protected from damage caused by vehicles running over them. h) Electrical equipment cords, including extension cords brought onto the project, must not have cuts, or other defects, and must be free of repairs. Splices completed by a qualified electrician are allowed if the insulation is intact and usage characteristics are the same as a new cord. i) Seller must ensure that all job-related injuries and illnesses, no matter how minor, are reported to BE&K immediately. Seller must submit a weekly report on all occupational injuries and illnesses to BE&K’s Subcontract Coordinator, including the completed individual injury report form. j) Toolbox safety meetings must be conducted daily, and one (1) weekly meeting must be fully documented with content and attendance. Miscellaneous Requirements. (1) The time at which an employee takes his/her vacation will be determined with due regard for the wishes of the employee, the date of application for a specific vacation period, the department seniority of employees, and with particular regard for the needs of the department. (2) Employees may change vacation leave to sick leave, with approval of the Police Chief, in the event an employee on vacation becomes ill to the point that the Police Chief is convinced the employee would not normally be capable of performing his/her duties were he/she at work. (3) Where the total vacation accrual ends with a fraction of a working day, the vacation amount will be rounded to the nearest ½ hour. (4) In computing vacation leave, no vacation shall be earned during leaves of absence without pay or during disciplinary action. (5) If an employee is unable to take his/her scheduled annual vacation because of circumstances within the department or for personal reasons, such annual vacation may be allowed at a later date when convenient to the department. This will allow the consideration by the City of a request from an employee to carry over vacation solely for the convenience of the employee to facilitate a longer vacation period in a subsequent year, providing the Police Chief agrees that such carry-over can be accommodated within the department without adversely affecting the department’s capability of carrying on its functions, and the City Manager approves such request for vacation carry-over. The maximum allowable vacation accrual will be 300 hours as of December 31st of each year. Employees may accrue more than 300 hours during the calendar year provided that the employee’s accrual is not more than 300 hours by December 31st of each year. Should an employee have an accrual in excess of 300 hours on any December 31st, such employee will not accrue any further vacation until his/her accrual is at 300 hours. By November 1st of each year, an employee nearing or over 300 accrued hours may request accrual beyond 300 hours effective December 31st if he/she feels his/her timely requests for vacation have been repeatedly and unreasonably denied. Each case will be considered individually and the Police Chief, with approval of the City Manager, may authorize accrual beyond 300 hours in such cases where it is determined that the employee has made a good faith effort to take vacation but was unable to do so because of the department’s vacation policy. Miscellaneous Requirements. Whatever method of compacting backfill is used, care shall be taken that stones and lumps shall not become nested and that all voids between stones shall be completely filled with fine material. Only approved quantities of stones and rock fragments shall be used in the backfill; the Contractor shall, as part of the work done under the items involving earth excavation and rock excavation as appropriate, furnish and place all other necessary backfill material. All voids left by removal of sheeting shall be completely backfilled with suitable materials, and thoroughly compacted. Excavated material which is acceptable to the Engineer for surfacing or pavement sub-base shall be placed at the top of the backfill to such depths as may be specified elsewhere or as directed. The surface shall be brought to the required grade and stones raked out and removed.
