Minor Deficiencies definition

Minor Deficiencies means deficiencies which do not involve risk to life, health, or safety of the children enrolled at the child care center.
Minor Deficiencies means shortfalls or delays that are not inconsistent with industry accepted standards, which standards applicable to the Product shall be clarified in the Technical Agreement.

Examples of Minor Deficiencies in a sentence

  • Project Co shall, by the date which is 20 days prior to the anticipated Substantial Completion Date as set out in Project Co’s notice, prepare a list, in electronic format on software that identifies deficiencies by division, trade and location (“Project Co’s Preliminary Minor Deficiencies List”) of Minor Deficiencies, including an estimate of the cost of and the time for rectifying such Minor Deficiencies.

  • Minor Deficiencies List means the list of Minor Deficiencies prepared by the Consultant in accordance with GC 5.5.2.

More Definitions of Minor Deficiencies

Minor Deficiencies means those deficiencies that do not impair the safety, permanency or well being of a child in the agency’s care.
Minor Deficiencies meaning deficiencies that in and of themselves, and also in the process of being remedied, do not and will not: (i) adversely affect the seaworthiness of the Vessel; or (ii) prevent the unrestricted use of the Vessel in its intended service and purpose as described in the Specifications; or (iii) affect the safety of the Vessel’s crew or their ability to carry out their duties in a safe working environment and with appropriate accommodation; or (iv) adversely affect the operational efficiency of the Vessel; or (v) involve any condition, qualification, recommendation, reservation or restriction in relation to any certificate issued (or to be issued) by the Classification Society or any Regulatory Authority which in the opinion of the Buyer (acting in good faith and being reasonable) is or could be material in a commercial or technical sense, always provided that: (aa) the Seller undertakes in writing to remedy such minor deficiencies after delivery at the Seller’s entire risk and expense, without any interruption to the Vessel’s service, and within a convenient timeframe in accordance with a remedial plan and timetable approved by the Buyer (acting in good faith and being reasonable); or (bb) the Parties agree prior to the Delivery that the total amount of Contract Price be adjusted on account of such minor deficiencies.

Related to Minor Deficiencies

  • Minor defect means a defect which is not a Major Defect.

  • Immaterial Title Deficiencies means minor defects or deficiencies in title which do not diminish more than 2% of the aggregate value of the Oil and Gas Properties evaluated in the Reserve Report used in the most recent determination of the Borrowing Base.

  • Major Defect means a condition that exists on a ground ambulance vehicle that requires the Department or the certificate holder to place the ground ambulance vehicle out-of-service.

  • Significant deficiency means a shortcoming in the system that materially affects the ability of officials of the Department of Defense to rely upon information produced by the system that is needed for management purposes.

  • Deficiencies means defects arising from non-conformity with the mutually agreed specifications and/or failure or non-conformity in the Scope of the Services.

  • Minor Default means any Event of Default that is not a Major Default.

  • Deficiency in service means, not deploying the full contingent of the Data Entry Operator requisitioned on time, non-replacement of Data Entry Operator who are found to be un- suitable, failure to provide suitable replacement to the absentees, non-payment of wages within the time prescribed, short payment of wages, short remittance of statutory payments, failure to submit the relevant details of the Data Entry Operator deployed to the Department, failure to submit/file statutory statements/returns as per the requirement of the applicable laws and violation of any of the condition in the contract agreement.

  • Advance Deficiency As defined in Section 4.01(b).

  • Mental deficiency means mental deficiency as defined by appropriate clinical authorities to such extent that a person so afflicted is incapable of managing himself and his affairs, but shall not include mental illness as defined herein.

  • Gas Supply Deficiency means any occurrence relating to Seller's gas supply which causes Seller to deliver less than the total requirements of its system, including failures of suppliers to deliver gas for any reason, requirement of gas for system storage, conservation of gas for future delivery, or any other occurrence which is not enumerated herein which affects Seller's gas supply.

  • Operating Deficit means, for the applicable period, insufficient funds to pay operating costs when Cash Expenses exceed Cash Receipts, as determined by the Accountant and approved by the Special Limited Partner.

  • Erroneous Payment Return Deficiency has the meaning assigned thereto in Section 10.12(d).

  • Major Default means any Event of Default occurring under Sections 4.1(a), 4.1(c), 4.1(l), or 4.1(p) of this Note.

  • Minor Servicing Defect With respect to each Payment Date and any Reference Obligation for which Freddie Mac has determined the existence of an Unconfirmed Servicing Defect, the occurrence of a remedy, other than by repurchase or Make-Whole that is mutually agreed upon by both Freddie Mac and the related servicer that results in a recovery of the damages sustained by Freddie Mac on such Reference Obligation as a result of the Unconfirmed Servicing Defect.

  • Daily Deficiency Rate means the rate employed to assess certain deficiency charges under Xxxxxx, Attachment DD, section 7, Tariff, Attachment DD, section 8, Tariff, Attachment DD, section 9, or Tariff, Attachment DD, section 13.

  • Defects means any part of the Works not completed in accordance with the Contract, or completed with deficiencies and flaws and includes deficiencies, flaws, etc. developed during the execution of Works and during the Defect Liability Period.

  • Accumulated Funding Deficiency as defined in Section 302 of ERISA.

  • Performing Note Deficiency means any time that less than 65% of the then aggregate outstanding principal amount of all Equipment Notes are Performing Equipment Notes.

  • Reportable Modified Mortgage Loan Any Mortgage Loan that (i) has been subject to an interest rate reduction, (ii) has been subject to a term extension or (iii) has had amounts owing on such Mortgage Loan capitalized by adding such amount to the Stated Principal Balance of such Mortgage Loan; provided, however, that a Mortgage Loan modified in accordance with clause (i) above for a temporary period shall not be a Reportable Modified Mortgage Loan if such Mortgage Loan has not been delinquent in payments of principal and interest for six months since the date of such modification if that interest rate reduction is not made permanent thereafter.

  • Single event permit means a permit issued in accordance with Chapter 9, Part 3, Single Event Permit.

  • Material Project EBITDA Adjustments means, with respect to each Material Project:

  • Reportable Event means any of the events set forth in Section 4043(c) of ERISA, other than events for which the 30 day notice period has been waived.

  • Major Servicing Defect With respect to each Payment Date and any Reference Obligation for which Freddie Mac has determined the existence of an Unconfirmed Servicing Defect, the occurrence of any of the following: (a) the related servicer repurchased such Reference Obligation or made Freddie Mac whole resulting in a full recovery of losses incurred (“Make- Whole”) during the related Reporting Period; or (b) the party responsible for the representations and warranties and/or servicing obligations or liabilities with respect to the Reference Obligation becomes subject to a bankruptcy, an insolvency proceeding or a receivership. Reference Obligations covered under servicing settlements will not result in Major Servicing Defects.

  • Latent Defects means such defects caused by faulty designs, material or work-man- ship which cannot be detected during inspection, testing etc, based on the technology available for carrying out such tests.

  • Reportable Compliance Event means that any Covered Entity becomes a Sanctioned Person, or is charged by indictment, criminal complaint or similar charging instrument, arraigned, or custodially detained in connection with any Anti-Terrorism Law or any predicate crime to any Anti-Terrorism Law, or has knowledge of facts or circumstances to the effect that it is reasonably likely that any aspect of its operations is in actual or probable violation of any Anti-Terrorism Law.
