Mining Real Property definition

Mining Real Property means all immovable properties and/or lease, surface use and/or access rights or servitudes over immovable properties, or portions of immovable properties, within the Mining Areas which are or may be accessed, used, required and/or occupied for the purposes of the Project (including the Leased Properties), the Mining Right, all real property interests, mineral claims, mineral leases and other mineral rights, concessions and interests, and all surface access rights relating to the Project, in each case, to the extent required for the development or operation of the Project.
Mining Real Property means all immovable properties and/or lease, surface use and/or access rights or servitudes over immovable properties (or portions of immovable properties) and/or access or servitudes over immovable properties, or portions of immovable properties in or outside of the Mining Area which are required for the development or operation of the Project or enjoyment of the Mining Licence (through the Operating Agreement), and all real property interests, mineral claims, mineral leases and other mineral rights, concessions and interests, and all surface access rights relating to the Project, in each case, to the extent required for the development or operation of the Project (excluding any of the foregoing which relate to the area covered by the Gergarub Mining Licence).
Mining Real Property means all usufruct rights and/or access or services servitudes over immovable properties, or portions of immovable properties, in the Mining Areas which are or may be accessed, used, required and/or occupied for the purposes of the Mine (including those usufructs and servitudes over the Usufruct and Servitude Properties, the Mining Right, the Project Company’s rights under and in connection with each of the Tailings Access Agreement and, once executed, the Tailings Direct Agreement, all real property interests, mineral claims, mineral leases and other mineral rights, concessions and interests, and all surface access rights relating to the Mine but specifically excluding the property located at N▇. ▇, ▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇, ▇▇▇▇▇ ▇▇▇▇▇▇);

Examples of Mining Real Property in a sentence

  • No Company has leased, licensed or otherwise granted to any Person (other than the Companies) the right to use or occupy such Mining Real Property.

  • There are no options, contracts, or other agreements under which any Company has a right to purchase, lease or otherwise acquire, or the obligation to sell, lease, or otherwise divest, any Mining Real Property or interests in Mining Real Property.

  • To the Knowledge of the Company, no condemnation proceeding or proposed Action or agreement for taking in lieu of condemnation with respect to the Mining Real Property is pending or threatened.

More Definitions of Mining Real Property

Mining Real Property means, with respect to the Redwing Mine, the Mazowe Mine, and the How Mine, all land, or portions thereof, together with all buildings, structures, material improvements and material fixtures located thereon, and all easements and other rights and interests appurtenant thereto, including any owned real property or leases of any real property, which are or may be accessed, used, required and/or occupied by the Group Companies.
