Minimum Performance Obligations definition

Minimum Performance Obligations means the Minimum Performance Requirements to be met by the Preferred Bidder /Concessionaire during operations and maintenance of the Project; the details of the Minimum Performance Obligations are given in the RFP.
Minimum Performance Obligations shall have the meaning set forth in SECTION 9.1.

  • In the event of default in the performance of any of Authorized Supplier’s covenants and obligations herein (including but not limited to the any Minimum Performance Obligations in Exhibit “B” hereto or any of WSI’s standards for authorized suppliers prescribed from time to time), WSI shall notify Authorized Supplier of such default and provide 30 days notice to cure.

  • Additional Performance Security means the Bank Guarantee to be submitted by Successful Bidder in accordance with Clause 8.7 of this RFP Document

  • Extreme performance coating means coatings designed for harsh exposure or extreme environmental conditions.

  • Capacity Performance Resource means a Capacity Resource as described in Tariff, Attachment DD, section 5.5A(a).

  • Qualified Performance-Based Award means an Award intended to qualify for the Section 162(m) Exemption, as provided in Section 11.

  • Earn Out Obligations means, with respect to an Acquisition, all obligations of the Borrower or any Subsidiary to make earn out or other contingency payments (including purchase price adjustments, non-competition and consulting agreements, or other indemnity obligations) pursuant to the documentation relating to such Acquisition. The amount of any Earn Out Obligations at the time of determination shall be the aggregate amount, if any, of such Earn Out Obligations that are required at such time under GAAP to be recognized as liabilities on the consolidated balance sheet of the Borrower.

  • Performance Cash means any cash incentives granted pursuant to Article 9 payable to the Participant upon the achievement of such performance goals as the Committee shall establish.

  • Non-Performance Charge means the charge applicable to Capacity Performance Resources as defined in Tariff, Attachment DD, section 10A(e). Nonincumbent Developer:

  • Compliance obligation means the quantity of verified reported emissions or assigned emissions for which an entity must submit compliance instruments to ARB.

  • Safety Obligations means all applicable obligations concerning health and safety (including any duty of care arising at common law, and any obligation arising under statute, statutory instrument or mandatory code of practice) in Great Britain;
