In the event any carbon emissions tax or other greenhouse gas assessment is imposed on Midla with respect to New Midla Pipeline, or if Midla is required to incur additional expense to comply with any greenhouse gas laws, rules, or regulations with respect to New Midla Pipeline, then New Midla Pipeline will seek to have such amounts recovered through a FERC approved surcharge applicable to all shippers on the New Midla Pipeline.
Notwithstanding anything to the contrary contained in this Agreement or the Tariff, Shipper shall have the right to intervene or protest any FERC filing by Midla with respect to such amounts described in this subsection 5(c)(ii).
