MH Contracts definition

MH Contracts means the promissory note, installment loan agreement and/or installment sales contract, which evidence the loans described on the Data Tape (together with all security interests, collateral securing such loans, and other items described in Section 2.01(b) below).
MH Contracts means all retail installment sales contracts and Loan agreements for manufactured housing, including, without limitation, retail installment sales contracts and Loan agreements for manufactured housing that has been repossessed and refinanced.
MH Contracts shall include without limitation all MH Contracts now owned or hereafter acquired by Borrower and all MH Contracts to which Borrower is now or hereafter a party; or

  • Except for the effect of the representations and warranties made hereunder, no adverse selection procedures have been employed in selecting the MH Contracts.

  • Recognizing that, pursuant to subsequent terms and provisions of this assignment, that the Leases and MH Contracts may never be paid to Lender, Borrower acknowledges and agrees that the execution and delivery of this assignment absolutely transferring ownership of the Assigned Documents and Liens to Lender does not constitute any nature of pro tanto payment of the Loan to Lender.

  • Company has good and valid title to all of the Inventory, all of the Intangibles and each of the MH Contracts (including the related assets described in Section 2.01(b)), free and clear of all Liens.

  • Notwithstanding any of the other terms or provisions of this assignment, until Borrower’s License to collect MH Contracts is terminated as a result of the occurrence and continuance of an Event of Default, the Homeowners shall pay the amount due under the MH Contracts to Borrower.

MH Contracts means the promissory notes, installment loan agreements and installment sales contracts set forth on the attached Exhibit B (together with all security interests and collateral securing such loans). The attached Exhibit B sets forth as to each MH Contract identified on it (i) its account number, (ii) the unpaid principal thereof at the Cut-Off Date, after giving effect to all installments of principal due on or prior thereto, and aging data on delinquent payments, if any, (iii) the amount of monthly payments due from the Obligor, (iv) the MH Contract Rate, (v) the documentation type, and (vi) the maturity date.
