MEPPA definition

MEPPA shall have the meaning set forth in Section 4.2(a).
MEPPA means the Multi-Employer Pension Plan Amendments Act.
MEPPA is the Multiemployer Pension Plan Amendments Act of 1980, as amended.

  • Said Employer’s obligations shall also be considered within and limited by the construction industry exemption of the Employee Retirement Income Security Act (“ERISA”), as amended by the Multiemployer Pension Plan Amendments Act of 1980 (“MEPPA”) as long as said Employer is a construction industry employer within the meaning of 29 U.S.C. 1383(b) of ERISA and/or MEPPA.

  • Notwithstanding anything to the contrary contained in this Agreement, the following subparagraphs (b) and (c) shall apply to any liability that may, from time to time, arise out of the Employee Retirement Income Security Act of 1974 ("ERISA") and the Multi-employer Pension Plan Amendments Acts of 1980 ("MEPPA"), respectively, as from time to time amended.

  • No portion of the Properties is, or by this transaction shall become, burdened by any liability or contingent liability under any such employee benefit plan, the Internal Revenue Code of 1986, as amended (the "Code"), ERISA or the Multiemployer Pension Plan Amendments Act of 1980, as amended ("MEPPA") and the purchase and sale contemplated herein shall not cause any loss or liability under any such employee benefit plan, the Code, ERISA or MEPPA for Seller or Buyer.

  • Within five (5) business days after execution of this Agreement (but no later than the Closing Date), Buyer and the Seller shall agree on the mechanics of compliance with Section 4204 of MEPPA.

  • Seller agrees that if the Buyer withdraws in a complete withdrawal, or partial withdrawal, under any such Plan prior to the end of the fifth (5th) full plan year beginning after the Closing, Seller shall be secondarily liable for any withdrawal liability Seller would have had to the Plans (but for Section 4204 of MEPPA) if Buyer does not pay its withdrawal liability to the Plans.

  • The parties agree to furnish each other with such information concerning employees and employee benefit plans, and to take all such other action, as is necessary and appropriate to effect the transactions contemplated by this Agreement and to cooperate with each other in addressing inquiries and mitigating any MEPPA withdrawal liability to the extent of any available information.

  • Due to the transactions contemplated by this Agreement, it is possible that either a complete or partial withdrawal by the Seller from a Union Pension Plan could occur as provided under MEPPA.

  • Notwithstanding anything to the contrary contained in this Agreement, the following subparagraphs (a) and (b) shall apply to any liability that may, from time to time, arise out of the 24 Employee Retirement Income Security Act of 1974 ("ERISA") and the Multi-employer Pension Plan Amendments Acts of 1980 ("MEPPA"), respectively, as from time to time amended.
