MEMC Technical Information shall have the respective meanings given to such expressions by the TCA and the expression "secret or confidential information" includes all such information and other materials as shall be marked "CONFIDENTIAL" or "SECRET" or is by its nature intended to be retained in confidence) given to or received by a PARTY and whether given by the JVC or another of the JVC Members.
