• A contract between the Centers for Medicare & Medicaid Services (“CMS”) and a Medicare Advantage Organization for the provision of Medicare benefits pursuant to the Medicare Advantage Program under Title XVIII, Part C of the Social Security Act.

• To ensure compliance, Dentist agrees to either (i) accept MA Plan’s Medicare Advantage Program payments as payment in full, or (ii) bill the State Department of Public Welfare (DPW) for the amounts that are the responsibility of the State Medicaid program.

• To the extent that any greater rights or obligations between the parties are created in these provisions than are in the Agreement, such rights and obligations shall only apply to Covered Services provided under the Medicare Advantage Program.
