Examples of MDE Certification in a sentence

• The Company may not elect Optional Deferral for an Interest Payment Date if (i) the Company has failed to pay any amount of optionally deferred interest on the Notes for any reason for a period of ten consecutive years or (ii) the Company has failed to pay any amount of deferred interest on the Notes for any reason for a period of twelve consecutive years, in each of cases (i) and (ii) including as a result of the delivery of an MDE Certification pursuant to Section 4.2.
