Maximum Request as defined in Section 2.4(a). "Moody's": Mxxxx'x Investors Service, Inc., or any successor thereto. "Person": any individual, firm, partnership, joint venture, corporation, association, business enterprise, limited liability company, joint stock company, unincorporated association, trust, Governmental Authority or any other entity, whether acting in an individual, fiduciary, or other capacity, and for the purpose of the definition of "ERISA Affiliate", a trade or business. "Plan": any employee pension benefit plan (other than a Multiemployer Plan) subject to the provisions of Title IV of ERISA or Section 412 of the Code or Section 302 of ERISA, and in respect of which the Borrower, any Subsidiary or any ERISA Affiliate is (or, if such plan were terminated, would under Section 4069 of ERISA be deemed to be) an "employer" as defined in Section 3(5) of ERISA. "Portion": as defined in Section 2.4(b). "Pricing Level": Pricing Level I, Pricing Level II, Pricing Level III, Pricing Level IV, Pricing Level V, or Pricing Level VI, as the context may require. "Pricing Level I": any time when (i) no Event of Default has occurred and is continuing, and (ii) the Senior Debt Rating is A+ or higher by S&P or A1 or higher by Moody's. "Pricing Level II": any time when (i) no Event of Default has occurred and is continuing, (ii) the Senior Debt Rating is A- or higher by S&P or A3 or higher by Moody's and (iii) Pricing Level I does not apply.
Maximum Request means that quantity of Bulk Drug Substance [*] in accordance with Section 5.1(a) - (c) hereof.

More Definitions of Maximum Request

Maximum Request shall have the meaning assigned to that term in Section 2.03(a).
Maximum Request means the maximum aggregate amount of Bid Loans requested by a Borrower for all Interest Periods in a single Bid Loan Request pursuant to Section 7.1 or 8.1 (which amount shall not be greater than the amount permitted by Section 7.2 or 8.2, as the case may be).
