Examples of MARVIN in a sentence

  • Notwithstanding any provision to the contrary in this Contract, in the event MARVIN is subject to a withhold by its Customer because of a nonconformance in the SELLER's Work, a corresponding withhold shall be assessed against and shall be paid by the SELLER as a temporary or permanent reduction, as the case may be, in the price of the affected Work.

  • Except for non-performance of subcontractors at any tier, SELLER shall not be liable for liquidated damages if the failure to deliver Work on time arises from causes beyond the reasonable control and without the fault or negligence of the SELLER.The remedies contained in this clause are in addition to any remedies MARVIN may have at law, equity or under other provisions of this Purchase Order, Contract or Scheduling Agreement.
