Prior to the Closing or the termination of this Agreement, Seller shall, and shall cause the NFP to, use commercially reasonable efforts in accordance with past practice to sell or maintain and preserve all Marijuana Inventory owned by the Business in a good and saleable condition in all material respects, including being free from mildew, fungus, rot, spoilage, infestation and agricultural neglect in all material respects.
