Make Right Performance Guarantees definition
Make Right Performance Guarantees means those Performance Guarantees designated as such in Exhibit L for which the payment of a Performance Liquidated Damage as a remedy shall not be an option for Contractor, which shall include the Guaranteed Emission Limits but only to the extent that the failure to meet any such limits are attributable to Contractor’s scope of Work set forth in Section 3.1(a)(ii)(B).
