Borrower covenants that the proceeds of the Term Loan will be used solely for the purpose of (a) reimbursing Borrower for the costs and expenses associated with this term loan facility and (b) manufacturing and installing equipment and software for use in connection with the Lottery Agreement.
For the avoidance of doubt, except as specifically amended pursuant to this Agreement, the On-Line Lottery Agreement and the Video Lottery Agreement shall continue in full force and effect, enforceable by the parties in accordance with its terms.
