Loss of capacity for work definition

Loss of capacity for work means loss of capacity for work as a result of an occupational accident, an accident on the way to/from work or due to contracting an occupational disease. The incapacity for work shall be expressed in percentages. Should the victim die as a result of an occupational accident, an accident on the way to/from work or due to an acute occupational disease, it shall be considered as loss of a 100 per cent capacity for work. The Disability and Capacity for Work Establishment Office under the Ministry of the Social Security and Labour (hereinafter referred to as the “DCWEO”) shall, in accordance with the procedure laid down by the Government or an institution authorised by it, establish the loss of capacity for work as a result of an occupational accident, an accident on the way to/from work, or due to contracting an occupational disease.
