Limited Exclusive definition

Limited Exclusive means with respect to the License granted to Prometheus hereunder, exclusive even as against Rosetta and its Affiliates, but subject to any co-exclusivity terms and other retained rights of Upstream Licensors and their licensees (other than Rosetta and its Affiliates) of the Upstream Licensed Patents and/or any Upstream Licensed Technical Information.

  • Forty Seven, itself or through a designee, has the first right to institute suit, or defend any action for declaratory judgment, relating to the Exclusive Patents and/or the Limited Exclusive Patents, and may name Stanford, subject to the requirements of this Section 14.4, as a party for standing purposes.

  • The purpose of this Amendment One is to reflect a change in the scope of the original License Agreement to include the licensing of certain trademarks owned by THE REGENTS, as provided for in Attachment 1 (entitled "Limited Exclusive Patent, Copyright and Trademark License Agreement") to this Amendment One which is incorporated in its entirety by this reference.
