If a tenancy fails to complete after the holding amount has been received from the prospective tenant, the owner or landlord (as the case may be) shall still be liable to the Letting Fee and the owner/landlord hereby agrees that the Agent may deduct such fee from the tenant’s holding amount that has been paid to the agent and agrees to pay the Agent and shortfall that cannot be collected from the holding amount paid by the prospective tenant/s.
