The Certified Net Lettable Floor Area shall not be less than 95% of the Contracted NLA.
Within five (5) Working Days following the date of such notice the Landlord and the Tenant shall respectively procure that the Landlord’s representative and the Tenant’s representative shall jointly measure and endeavour to agree the Nett Lettable Floor Area of the Premises.

The Certified Net Lettable Floor Area shall be inserted in the First Schedule of the Lease Agreement as the floor area of the Premises.
Third Floor €45.00 Fourth Floor €45.00 If for any reason the Nett Lettable Floor Area of the Premises has not been agreed or determined by the Rent Commencement Date, the Initial Yearly Rent payable by the Tenant from the Rent Commencement Date, (subject to Clauses 4.3.1 and 4.3.2), shall be the Estimated Rent.
The NLA so determined by the registered surveyor and certified by such registered surveyor in a certificate (the "NLA Certificate") to the Tenant or Landlord and Tenant (the "Certified Net Lettable Floor Area") shall be final and conclusive.
Payments shall be calculated in the first instance based on the Estimated Area in substitution for the Nett Lettable Floor Area (the “Estimated Landlord Contribution”).
For the avoidance of doubt, the rent and service charge payable under the Lease Agreement shall be computed on the Certified Net Lettable Floor Area, provided that if the Certified Net Lettable Floor Area exceeds 105% of the Contracted NLA, the rent and service charge payable under the Lease Agreement shall be computed based on 105% of the Contracted NLA.
