The Lessee must comply with the Works Conditions in carrying out all Maintenance and any other work which affects the Leased Premises, the Lessee’s Building and Fixtures.
If the Leased Premises are damaged or destroyed and the Lease is terminated under this clause 16, the Lessee will have no interest in the insurance proceeds other than those proceeds that relate to the Lessee’s Building and Fixtures and contents.
The Lessee will not be in breach of the covenant in clause 15.1 in respect of a sublease of the whole or part of the Leased Premises and the Lessee’s Building and Fixtures if the Lessor consents to the sublease.
Despite any rule of law or equity to the contrary, title to and ownership of the Lessee’s Works shall be the property of the Lessee regardless of their attachment or affixation to the Leased Premises, and shall be a Lessee’s Building and Fixtures unless re-classified as a Lessor's Fixture in accordance with this Lease.
The Lessee shall comply promptly with all other Laws affecting the Leased Premises, the Lessee’s Building and Fixtures or the use of the Leased Premises and the Lessee’s Building and Fixtures including any structural work in respect of the Lessee’s Works, including the Health Act 1922 (WA), the Health (Public Buildings) Regulations 1992, the Environmental Protection Act 1986 (WA) and the Environmental Protection (Noise) Regulations 1997.
The Lessee’s Building 63 employees will have access to ▇▇▇▇▇▇’▇ ▇▇▇▇▇▇ Pines Industrial Center for use of the central cafeteria, fitness center (members only) and all outside recreation complex as well as access to Lessor’s private road (Tower Road) for use of access between ▇▇▇▇▇▇ ▇▇▇▇▇ and Sorrento West Complex.
Lessee shall make no claim against Lessor for damages for termination of the leasehold interest or interference with Lessee’s Building.
In the event the Lessee shall elect to repair Lessee’s Building located on Leased Premises, then and in such event, the Lessee shall resume the lease of said Leased Premises upon completion of said repairs.
Lessor shall not be liable for any theft from the dwelling or other injury on the Lessee’s Building or the Leased Premises of Lessee, his or her family, guests, agent, or invitees.
Lessee’s proportionate share of such Building Operating Expenses and Common Area Operating Expenses shall be based upon Lessee’s Building Percentage in the case of Building Operating Expenses and upon Lessee’s Common Area Percentage in the case of Common Area Operating Expenses, all as defined herein.
