LESSEE COMPETITOR definition

LESSEE COMPETITOR means a Person that conducts, as a significant component of its business, the management, operation or marketing of communications towers, and does not provide wireless communications services as a substantial portion of its business.
LESSEE COMPETITOR means (i) each person or entity whose name appears on the most recently revised Competitor List which has been sent to LESSOR prior to the commencement by LESSOR of negotiations for such sale or assignment or lease or prior to LESSOR being requested to approve any such sublease and (ii) all affiliates of such person or entity. Attached hereto as Exhibit "E" is the current list (the "Competitor List") of LESSEE's competitors. ----------- LESSEE shall have the right to update the Competitor List no more often than once every twelve (12) months during the Term. In updating the Competitor List, Lessee may add thereto any person or entity that at the time of such updating is engaged, directly or indirectly, within any of the fifty (50) states of the Xxxxxx Xxxxxx, Xxxxxxxx xx Xxxxxxxx, Xxxxxx Xxxx, Xxxxxx or the United Kingdom, (a) in the business of consumer credit reporting, collection of consumer debt or obligations, consumer check credit clearance or guarantee, consumer marketing studies or surveys, consumer reports for life or property and casualty insurers, automation of data for use by insurers or providers in the health care industry, design or implementation of alliances for delivery of health care services, or (b) in any other business in which LESSEE or its affiliates shall then be engaged, if the revenues from such other business comprised as much as two percent (2%) of the revenue of LESSEE or its affiliates realized throughout the preceding four (4) fiscal quarters of LESSEE, on a consolidated basis, and if the revenues of such proposed assignee, realized throughout its preceding four (4) fiscal quarters derived from such other competing business or businesses, on a consolidated basis, were as much as twenty percent (20%) of the gross revenues of such proposed assignee during such fiscal period, on a consolidated basis.

  • Direct Competitor means any individual, partnership, corporation, limited liability company, association, or other group, however organized, who competes with the Company in the full service restaurant business.
