Legally Intoxicated definition
Legally Intoxicated means either (1) the state of having an alcohol concentration as defined by the Texas Penal Code of 0.08 or more, or (2) not having the normal use of mental or physical faculties resulting from the voluntary introduction into the body of (a) an alcoholic beverage as defined by the Texas Alcoholic Beverage Code, (b) a controlled substance, controlled substance analogue, dangerous drug, an abusable glue or aerosol paint (as defined by the Texas Health and Safety Code), (c) a combination of two or more of the substances listed in (a) and/or (b), or (d) any other substance. "Legally Intoxicated" does not include the loss of normal use of mental or physical faculties resulting from the introduction into the body of a substance: (a) taken under and in accordance with a prescription written by a Physician, or (b) inhaled or absorbed incidental to employment with an Employer.
