With respect to any condemnation or taking (of any notice thereof), if Lessee does not elect to cancel this Agreement as aforesaid, there shall be no abatement of the Leasehold Transaction Price and Lessor shall assign to Lessee at the Closing the rights of Lessor to the awards, if any, for the condemnation or taking, and Lessee shall be entitled to receive and keep all such awards.
Lessor hereby waives any right to recover the balance of the Leasehold Transaction Price, or any part thereof, and the right to pursue any other remedy permitted at law or in equity against Lessee.
The Closing shall consist of the execution and delivery of documents by Lessor and Lessee, with respect to each Property as set forth below, and delivery by Lessee to Lessor of the Leasehold Transaction Price in accordance with the terms of this Agreement.
