Leased Conduit definition

Leased Conduit means the portion of the City System described in Exhibit A (Sheets 1 and 2), attached hereto and incorporated herein.

Leased Conduit means the Primary Conduit, the Spurs, the County Laterals and the Additional Conduit, including all associated anchors, hangers, supports, clamps and supporting materials and related appurtenances.

  • The Lessee may not sublease or transfer their interest in the Leased Conduit.

  • At the expiration or termination of this Lease subject to this Aticle, all rights of Lessee to use the Leased Conduit, or any part thereof, shall cease, and the Lessee shall surrender to City possession of the Leased Conduit.

  • PROVIDED FURTHER THAT, if the City System and/or the Leased Conduit are totally destroyed, or rendered unusable, by a tforce Majeure Event, City may terminate this Lease Agreement, without liability to Lessee, as of the date of such Force Majeure Event.

  • Zayo shall do no act that would in any way encumber the City’s title to the Leased Conduit or the Lease Area nor permit them to become subject to a lien of any kind.

  • Prior to installing Zayo Fiber and City Fiber in the Leased Conduit, Zayo shall inspect that segment of the City Duct System, document the condition of the segment in a format agreeable to both Parties, and provide such documentation to the City.

  • Immediately upon the execution of this Agreement, Zayo shall pay to the City a one-time payment based on a formula of $5.50 per linear foot, which for the lease of the Leased Conduit equals SEVEN HUNDRED TWENTY-TWO THOUSAND TWO HUNDRED SEVENTY-ONE DOLLARS ($722,271).

  • Zayo shall be responsible for the operation, maintenance and repair of the Leased Conduit, the Zayo Conduit, the Zayo Fiber, the City Fiber and the 2 Strands of Dark Fiber.
