If any part of the LeapGreat Platform is in our opinion likely to or does become the subject of a Claim of infringement of an IP Right, we, at our option, shall: (a) replace or modify such part to become non-infringing; (b) procure the right for you to continue using the LeapGreat Platform; or (c) terminate the Subscription and Services.
We shall provide a team of resources, as outlined in the applicable SOW, to perform continuous improvement Services for the Implementation project previously delivered by us using the LeapGreat Platform, and the parties will meet at least bi-weekly to prioritize a list of updates, modifications and improvements to be covered by such Services.
Such support services do not include, and you shall pay additional Fees for, (a) new products or options sold separately by us; (b) any services related to calls from you where the problem proves to be a problem not attributable to the LeapGreat Platform; (c) support of any modified LeapGreat Content; and (d) professional services as outlined in Section 4.
