Launch Quantity definition

Launch Quantity has the meaning set forth in Section 7.3.
Launch Quantity means a quantity of Product adequate to meet the requirements set forth for the first six (6) months in the initial forecast to be provided by Sanofi-Synthelabo to Atrix as provided in Section 8.07.
Launch Quantity means a quantity of Product adequate to meet the requirements set forth for the first three (3) months in the Updated Unit Forecast.

Examples of Launch Quantity in a sentence

  • Payment will be due from Sandoz within [*] of the end of each calendar month in accordance with Section 5.2. Solely for the Launch Quantity, Sandoz shall pay Eagle, (A) upon the Effective Date, a Refundable milestone payment in an amount equal to [*] of the Launch Quantity purchase order, and (B) the remaining [*] of the Launch Quantity purchase order shall be paid to Eagle by Sandoz within [*] days of Sandoz’s receipt of the corresponding invoice.

  • Noven shall bear the risk of loss for all costs associated with manufacturing the Launch Quantities other than Endo's responsibility for Launch Quantity API and incremental manufacturing costs set forth above; and, in the event that Noven is bearing the cost of the API then Noven shall invoice Endo for the amount of the API cost for which Endo is responsible pursuant to this Section 3.09 at the time such API is received by Noven.


More Definitions of Launch Quantity

Launch Quantity means the amount of the Initial Product ordered by Eisai under all Purchase Orders submitted no later than five days after such Regulatory Approval of the Initial Product is obtained, which Purchase Orders shall be submitted in accordance with the agreed Launch Forecast under Section 6.2 and shall not exceed the quantity of the Initial Product specified in the Launch Forecast. No payment under Section 7.2 will be made more than once. For the avoidance of doubt, in no event shall Eisai pay more than US$160,000,000 under this Section 7.2 (or US$140,000,000 in accordance with Section 7.2(a) above).
Launch Quantity means the amount of the Initial Product ordered by Eisai under all Purchase Orders submitted no later than five days after such Regulatory Approval in the United States of the Initial Product is obtained, which Purchase 85 ***Confidential Treatment Requested Confidential Orders shall be submitted in accordance with the agreed Launch Forecast under Section 6.2 and shall not exceed the quantity of the Initial Product specified in the Launch Forecast. No payment under Section 7.3 will be made more than once (except as otherwise provided for the milestone events in subsection (n) above). For the avoidance of doubt, in no event shall Eisai pay more than US$292,500,000 under this Section 7.3 (of which US$86,000,000 has been paid by Eisai prior to the 2nd Amendment Effective Date).
Launch Quantity shall have the meaning ascribed to such term in Section 2.5(c).
Launch Quantity means the quantity of the Product under the first Purchase Order issued by Taro to IPC pursuant to Section 5.2 of this Agreement.
Launch Quantity shall have the meaning given in Section 2.2.1.
Launch Quantity means a quantity of Product determined by Fujisawa to be adequate to meet the requirements set forth for the first six months of the Initial Forecast.
