Any Very Large Consumer that accepts such market price quote shall be enrolled in the Program, be deemed a Participating Consumer, and be entitled to receive supply at the market price quoted by the Competitive Supplier pursuant to the terms and conditions of this Agreement.
Any New Eligible Consumer, other than a Very Large Consumer, that does not elect to opt-out of the Program as provided in this section will be automatically enrolled in the Program, will be deemed a Participating Consumer, and shall be entitled to receive supply at the prices listed in Exhibit A pursuant to the terms and conditions of this Agreement.
A Party that is (i) a Large Consumer, (ii) a Small Consumer, (iii) a not-for-profit organization that represents Small Consumers, (iv) a governmental agency that advocates on behalf of Small Consumers, or (v) a governmental agency that acts as a retail Load aggregator primarily for Small Consumers; provided, however that an End-Use Consumer may not be an Affiliate of a Transmission Owner, Generator, Other Supplier, Public Power Party or Environmental Party regardless of where located.
NB! In the case of example 2 concerning consumer cases, The Danish Association of Architectural Firms and FRI’s “Appendix to ABR-F for Agreements in Large Consumer Cases” must be included in the agreement basis.
For ease of reference, that provision is moved from the Small Consumer definition to the definition of Large Consumer.
Opt-In: With respect to any Very Large Consumer, that is in the largest industrial rate class and that is identified after the Effective Date, Competitive Supplier may contact such consumer and reasonably determine if such consumer is expected to consume more than 1,000,000 kWh per year.
