LANDesk means: • LANDesk International Limited, an Irish company, if Licensee has its primary office located outside of North America, Central America, South America (excluding Brazil), (collectively, the “Americas”), Japan or the People’s Republic of China. • LANDesk Software, Inc., a Delaware corporation, if Licensee has its primary office located in the Americas. • LANDesk Comércio de Software Brasil Ltda, a Brazilian company, if Licensee has its primary office located in Brazil. • LANDesk Software K.K., a Japanese company, if Licensee has its primary office located in Japan. • LANDesk (Beijing) Information Technology Co., Ltd., a Chinese company, if Licensee has its primary office located in the People’s Republic of China.
LANDesk is a registered trademark of Intel Corporation. Failure of any Licensed Party to comply with the Attribution Requirements, as set forth below, or in the main body of this Agreement shall be a material breach of the Agreement.
