Amended Lease No. 2 is terminated with respect to the Pacific Junction Property and neither Landlord nor Tenant shall have any further rights or liabilities thereunder with respect to the Pacific Junction Property from and after the date hereof, except for those rights and liabilities which by their terms survive the termination of Amended Lease No. 2.
The Company has delivered to the Trustee all environmental reports, studies, audits and other data and information in the possession or control of the Company relating to the Springdale Property, the L▇▇▇▇▇ Property, the Junction Property or the W▇▇▇▇ Property.

Upon the occurrence of an Event of Default, the Lien and/or security interest on the Springdale Property, the L▇▇▇▇▇ Property, the Junction Property and the W▇▇▇▇ Property created and vested by this Loan Agreement may be foreclosed.
To the best of the Owner’s knowledge, information and belief, each mining lease and mining claim constituting or relating to the ▇▇▇▇▇▇▇▇ Junction Property and the Hot Pot Property and the Mining Lease Agreement is fully and accurately disclosed on Schedule A1 or A2 respectively, to this agreement, is in good standing, has been properly recorded in accordance with all applicable laws, and all assessment work has been done and all rental and other amounts owing thereunder have been paid to the date hereof.
Upon registration of notice of the Royalty on title to the ▇▇▇▇▇▇▇▇ Junction Property and the Hot Pot Property, the Royalty will constitute a real property interest in the ▇▇▇▇▇▇▇▇ Junction Property, that will run with such claims and will be enforceable against the Owner and against any third party acquirer, assignee or transferee of all, or any part of, the ▇▇▇▇▇▇▇▇ Junction Property, and the royalty will constitute an overriding royalty against the Mining Lease Agreement.
The Owner will provide to BMGX a copy of all material contracts which relate to any of the ▇▇▇▇▇▇▇▇ Junction Property or the Hot Pot Property.
The Owner possesses, and will at all times during the term of this agreement possess, all material licenses, approvals and consents from all applicable levels of government and from all regulatory authorities that are required to properly conduct the business on the ▇▇▇▇▇▇▇▇ Junction Property and the Hot Pot Property.
BMGX, or its authorized agents or representatives, shall enter upon the Existing Properties at its own risk and expense and shall not hinder the operations and activities on or relating to the ▇▇▇▇▇▇▇▇ Junction Property and Hot Pot Property.
