If Seller fails to deposit with the Escrow Holder the amount of the Escrowed Funds to be refunded to Buyer within such three Business Day period, then such refund to Buyer shall be made from the Deposit held by Escrow Holder under the JDL Agreement.

Seller shall promptly provide Buyer with copies of the monthly operating statements received from Property Owner as provided in the JDL Agreement for the operation of the Property for each month commencing with the month during which the Effective Date occurs, and continuing for each full calendar month thereafter until the Closing Date.
