ISDA Protocol definition

ISDA Protocol means the ISDA 2018 U.S. Resolution Stay Protocol as published by ISDA as of July 31, 2018.

  • At such times as the parties to this Agreement have adhered to the ISDA Protocol and this Agreement is or is deemed modified or amended by the ISDA Protocol, the terms of the ISDA Protocol will supersede the terms of this QFC Addendum as included as part of this Agreement, and in the event of any inconsistency between this QFC Addendum and the ISDA Protocol, the ISDA Protocol will prevail.

  • At such times as State Street and any Fund or Portfolio party to this Agreement have adhered to the ISDA Protocol and this Agreement is or is deemed modified or amended by the ISDA Protocol, with respect to such adhering parties the terms of the ISDA Protocol will supersede the terms of this QFC Addendum as included as part of this Agreement, and in the event of any inconsistency between this QFC Addendum and the ISDA Protocol, the ISDA Protocol will prevail.

  • For purposes of incorporating the ISDA Protocol into this Agreement, (i) each party hereto that has identified itself as an Regulated Entity in its adherence letter to the ISDA Protocol shall be deemed to be a Regulated Entity (and all other parties hereto shall be deemed to be an Adhering Party) and (ii) this Agreement shall be deemed a Protocol Covered Agreement.

  • In the event of any inconsistences between this Agreement and the ISDA Protocol, the ISDA Protocol will prevail.

  • Notwithstanding anything to the contrary in the Agreement or any other agreement, the parties hereto expressly acknowledge and agree that the terms of the ISDA Protocol are incorporated into and form a part of this Agreement.

  • In the event a party adheres to the ISDA Protocol after becoming a party hereto, the terms of the ISDA Protocol will supersede and replace the terms of this §39 with respect to the party and its Protocol Covered Agreements (as defined under the ISDA Protocol) with all Covered Entities that are adhering parties to the ISDA Protocol.

  • FXDD further reserves the right to require Customer adherence to the aforementioned ISDA Protocol as a condition to trading with FXDD.

  • The ISDA Protocol also provides a mechanism for adhering parties to opt-in to special resolution regimes in other FSB member jurisdictions so long as the regimes meet conditions specified in the ISDA Protocol relating to creditor safeguards, which are consistent with the Key Attributes.
