The powers granted herein to the ISBA shall continue to be effective during any such time that Planning Attorney is subject to a temporary disability, or in the event of Planning Attorney’s death or permanent disability, shall continue until all obligations under this Agreement are satisfied, unless terminated earlier pursuant to Paragraph 7 below.
Moreover, the ISBA does not assume and shall not be responsible for any liabilities, duties, debts, or obligations of Planning Attorney and the ISBA shall not assume any liability for Planning Attorney’s actions or any failure to act prior to Planning Attorney’s death or disability.
This Agreement shall become immediately effective as of the date it is executed by the Planning Attorney and the ISBA.
Planning Attorney may revoke the appointment of the ISBA at any time Planning Attorney is alive and not subject to a temporary disability or permanent disability by providing written notice to the Parties to this Agreement.
Planning Attorney agrees to fully indemnify and hold harmless the ISBA against any claims, losses, damages, and expenses, including, without limitation, reasonable attorney fees, arising out of the duties and actions taken hereunder, except to the extent of the ISBA’s gross negligence, willful misconduct, or material breach of this Agreement.
During any time Planning Attorney is alive and is not subject to a disability, the ISBA may withdraw from this Agreement after providing thirty (30) days written notice of such intent to the Planning Attorney.
In addition to the annual fee set forth above, in the event of the Planning Attorney’s death or disability the ISBA shall be entitled to reimbursement of reasonable expenses incurred preforming tasks and duties under Iowa Court Rule 39.18.
NSCS is a member of the ISBA and adheres to the ISBA ethical standards.
Planning Attorneys who are ISBA members, admitted to practice since January 2014 - 2018 Annual Fee - $25.00.
Upon approval of the Academy’s charter, the Board will evaluate its needs relative to training available through ISBA and will select and enroll in the training program in which it will participate.
