  • In such cases, the Authorities will inform each other of such intended use and proceed along with the principles of the IOSCO EMMoU.

  • With respect to information shared between the SFC and the FCA, use of non-public information for Enforcement Purposes will be in accordance with the terms and conditions of the IOSCO EMMoU.

  • In cases where an Authority intends to use any non-public information obtained under this MoU in or for the purpose of taking enforcement actions, a request shall be made pursuant to the IOSCO MMoU or the IOSCO EMMoU (as the case may be) and any such request to use the non-public information for the purpose of taking enforcement actions shall be governed by the terms and conditions of the IOSCO MMoU or the IOSCO EMMoU (as the case may be).
