Investigation Termination Date definition

Investigation Termination Date shall be December 1, 2010.”
Investigation Termination Date means (a) with respect to any Creditors’ Committee, the date that is sixty (60) from the date of such Creditors’ Committee’s formation and (b) with respect to any other party in interest, the date that is seventy-five (75) days from the Petition Date.

Examples of Investigation Termination Date in a sentence

  • If the Creditors’ Committee, or, if no Creditors’ Committee is appointed, any party in interest determines that there may be a Challenge, it must notify the Debtors in writing (with a copy to the Agents) of its demand that the Debtors initiate an appropriate action or adversary proceeding relating thereto by not later than the Investigation Termination Date.

  • If no Committee Standing Motion is filed on or before the Investigation Termination Date, the Creditors’ Committee shall be forever barred from bringing or taking any such Challenge Action on behalf of themselves, the Debtors, or these estates, and the Debtors’ stipulations made in paragraph H (or in paragraph 29 with respect to Nordea), and the release (as set forth in paragraph 15) shall be binding on all parties in interest.

  • Notwithstanding anything to the contrary herein, if prior to the Investigation Termination Date the Chapter 11 Cases are converted to chapter 7 or if a trustee is appointed in the Chapter 11 Cases, the Investigation Termination Date shall be extended for an additional 60 days from the date of the conversion of the Chapter 11 Cases to chapter 7 or the date of the appointment of the chapter 11 trustee, as applicable.

  • Unless the Pre-Petition Lenders and Pre-Petition Agents consent in writing to such an extension, the Investigation Termination Date may not be extended.

  • Any Claim Stipulation that is not expressly challenged in an adversary proceeding (or with respect to which authority to obtain standing has not been requested as set forth above) before the Investigation Termination Date shall remain in full force and effect and shall permanently and irrevocably bind all entities and persons, despite the filing of any other adversary proceeding or motion in accordance with this paragraph.

  • If no such action or motion is filed on or before the Investigation Termination Date, all persons and entities shall be forever barred from bringing or taking such action and the Claims Stipulations shall be permanently and irrevocably binding upon all persons and entities.
