Into-Plane Agent definition

Into-Plane Agent means any person that: (i) executes a Fuel System Access Agreement; and (ii) obtains all necessary approvals and permits from the City to perform into-plane fueling services for Users at the Airport.

  • The Into-Plane Agent shall update the inventory periodically and secure such certificate if required from the fabricator, if necessary, in any event of any change, repair, modification etc., of the Hydrant Dispenser / pipe and other equipment containing such residual ATF.

  • Access Fee to be made by Supplier/ Into-Plane Agent under the Agreement shall be made without set off or counterclaim and without any deduction or withholding of any kind whatsoever, except in the case of income tax deductible at source on payments.

  • Except as provided expressly in the Agreement nothing contained in the Agreement shall restrict the rights of MAFFFL or the Supplier/ Into-Plane Agent, against the other, in respect of claims for breach of contract, negligence or otherwise howsoever arising prior to the date of termination under the Agreement.

  • The rights of access granted hereunder are not intended and shall not create any relationship akin to a lease nor will it confer on the Supplier/ Into-Plane Agent any interest in or any part of the Facility.

  • Withdrawals by Into-Plane Agents Custody of ATF shall be released by Operator to the Into-Plane Agent as it passes through the relevant hydrant pit valve connection, or up to the nozzle of the loading hose installed at the outlet flange at the loading bay (as the case may be).

  • Such Operating Losses that exceed the maximum limit, on an annualized basis, shall be appropriately assigned to Operator, Supplier, Other Suppliers or Into-Plane Agent who is found in default or where no such fault can be attributed it shall be assigned to Operator, at product cost inclusive applicable Taxes.

  • Supplier / Into-Plane Agent shall pay the charges of obtaining connections and for the usage of such utilities, facilities and infrastructure directly to the relevant providers.
