Internet Directory Listings are generally placed in Publisher’s databases and displayed to End Users based upon the business category and geography for which each such listing may be shown in response to an End User search query on the applicable Properties.
Publisher may change the organization, structure, content, appearance, geographic scope, functionality, and other characteristics of Internet Directory Listings without notice or obligation to Advertiser.
In addition to Oracle EBS, the system includes the use of other Oracle COTS products, including: Oracle Identity Management (OIM), Oracle Access Manager (OAM), Oracle Internet Directory (OID), SOA Suite, Weblogic Server, Webcache and WebGate, Mobile Field Service (MFS), Oracle Business Intelligence Enterprise Edition (OBIEE), Oracle Enterprise Manager (OEM), Oracle Business Availability Manager (BAM), Oracle Advanced Supply Chain Planning (ASCP), and Oracle Database 11g.
Unless expressly provided on the applicable Order, Addendum or in other applicable Service Terms, neither Publisher nor any Vendor make any representation or warranty with respect to traffic or usage statistics regarding Actions on, from or associated with any Internet Directory or any other Media or the levels of Actions, cost per Action, or click- through or similar rates per Action or the quality or conversion rate for any Advertisement.
In addition to those general rights afforded publishers listed above, as publisher of the Internet Directory, CBD has full discretion and is responsible for all policies and procedures associated with the Internet Directory, including determining the portal design/user interface/search engine logic, determining site functionality and vendor selection, and determining product and application enhancements.
Unless otherwise set forth in an applicable Order, each such geographical division shall be considered a separate Internet Directory.
Publisher may position Advertising in an Internet Directory in any location, in any sequence, and in association with any headings or keyword Publisher deems appropriate unless otherwise specifically noted in the applicable Order.
While maintaining its final authority to make changes, CBD agrees to consult with ▇▇▇▇▇ before making any “material” directory, printing, publishing, distribution changes, or changes to the technical architecture, production platform and tools, and/or the introduction of new applications, to the Internet Directory which may affect ▇▇▇▇▇’▇ obligations thereunder.
Sales representatives will facilitate actual sales of Internet Directory items, and in some cases, will require the assistance of an Internet fulfillment specialist to complete the product design and/or order completion.
