Installed Equipment means the equipment installed or to be installed by Access Seeker at the Co-Location Sites.

• Prior to Department executing the Exhibit A1, Certificate of Acceptance of All Installed Equipment, QESP shall provide Department with documentary evidence that the Equipment installed is the Equipment specified in Schedule R (Equipment to be Installed by QESP).

• For the avoidance of doubt, in all instances where this Agreement refers to Seller performing the acts of constructing, building or installing, said language shall be interpreted to mean that such work will be performed by duly licensed contractors properly retained by Seller in accordance with laws of the State of Hawai‘i.

• The Certificate of Acceptance of All Installed Equipment will not be unreasonably withheld by the Department.

• The QESP shall conduct thorough and systematic performance tests of each element and total system of the installed Equipment in accordance with the procedures specified in Schedule T (Systems Start-Up and Commissioning; Operating Parameters of Installed Equipment) prior to delivering to the Department the installation notification indicating that the Equipment is ready for inspection by the Department.

• The Department shall not commence the inspection of the Equipment in preparation for executing the Certificate of Acceptance of All Installed Equipment until QESP completes the training specified in Schedule V (QESP’s Training Responsibilities).

• The Initial Term shall commence on the first day of the Rent Interval set forth in the Equipment Schedule next following (i) the Commencement Date for all items of Installed Equipment and Inventory Equipment to be rented thereunder or (ii) Lessor's receipt of Acceptance Certificates for all items of On-Order Equipment to be rented thereunder.

• Under no circumstances will Carestream Dental accept any return of Installed Equipment more than 90 days after installation or any return of Small Equipment more than 90 days after shipping.

More Definitions of Installed Equipment

Installed Equipment means any antennae, routers, enhancers, monitoring units or other equipment, including but not limited to equipment forming part of the Network, which Excalibur Communications (GB) Ltd may agree to install or otherwise provide for installation by the Customer at any premises owned, occupied or controlled by the Customer. Installed Equipment excludes Additional Network Equipment; “Connection” means the connection of an end mobile user to a network or service provider such that the end user is capable of accessing and utilising the Airtime Services; “Downward Migration” means in respect of a Connection, the transfer (at the request of the Customer) from one tariff provided by the network/service provider (“the Old Tariff”) to another tariff provided by that same network/service provider (“the New Tariff”) which results in the Customer being charged a lower monthly line rental under the New Tariff than it was being charged under the Old Tariff and the phrase “Downward Migrated shall be construed accordingly; “Minimum Terms” means the minimum period of time which the Customer has agreed to maintain (a) Connections(s) under the Airtime Agreement; “Monthly Subsidy Amount” means the amount which is derived by dividing the Subsidy payable for a Connection by the number of months in the Minimum Term applicable to that Connection; and “Subsidy” means the sum payable by Excalibur Communications (GB) Ltd to the Customer as is determined by Excalibur Communications (GB) Ltd in its sole discretion, taking into consideration the number of Connections which the Customer is taking out and the applicable tariffs and the Minimum Term which the Customer is prepared to enter into.

Installed Equipment means the equipment installed or to be installed by Company at the Co-Location Sites.

Installed Equipment means Authorized Equipment, including No Charge Additional Authorized Equipment, Extra Charge Additional Authorized Equipment and any Unauthorized Equipment deemed to be Authorized Equipment under Section 5.6, if any, installed on a Tower or on Land.

Installed Equipment is defined in Section 5.4(a) hereof.

Installed Equipment means equipment owned by Wam!Net used on the Winstar Network.
