Both parties agree that upon the issuance of the Initial Acceptance Certificate, the Initial Acceptance shall be deemed to have occurred.
Following the delivery of the Initial Acceptance Certificate and subject to the terms thereof, no modifications, other than such configuration changes as are agreed upon by the Parties and may be necessary for purposes of carrying out the Simulations and/or for making the Software and the CBOT Deliverables available for trading in a real time live trading environment, shall be made to the Software or the CBOT Deliverables prior to the Go Live Date, without the written consent of the Parties.
