Infrastructure Credits definition

Infrastructure Credits means the credits to the Fee Payments in respect of the Company’s investment in Cost of the Infrastructure set forth in Section 3.02(a) hereof.
Infrastructure Credits means those special source revenue credits authorized by the Act, as specifically addressed in Section 5.01, hereof.
Infrastructure Credits means the annual infrastructure credits provided to the Company pursuant to the MCIP Act and Section 4.1(c) hereof with respect to the Infrastructure and shall include the Part 1 SSRCs and Part 2 SSRCs, as applicable.

Examples of Infrastructure Credits in a sentence

  • In case any one or more of the provisions of this Agreement shall, for any reason, be held to be illegal or invalid, the illegality or invalidity shall not affect any other provision of this Agreement, and this Agreement, the Infrastructure Credits shall be construed and enforced as if the illegal or invalid provisions had not been contained herein or therein.

  • The County shall not assign, transfer, or convey its obligations to provide Infrastructure Credits hereunder to any other Person, except as may be required by South Carolina law.

  • Subject to Sections 5.01 and 5.02 above, this Agreement shall terminate on the date upon which all Infrastructure Credits provided for herein have been credited to the applicable Company.

  • At no time may the cumulative amount of Infrastructure Credits received under this Fee Agreement exceed the actual amount of investment made by the Company in the Infrastructure.

  • Infrastructure Credits previously received and this Fee Agreement shall be terminated all as more fully set forth in Section 4.2(b).

  • No such sale, lease, conveyance, grant or assignment shall relieve the County from the County’s obligations to provide Infrastructure Credits to the Company, as the case may be, or any assignee of the same, under this Agreement as long as such assignee is qualified to receive the Infrastructure Credits under the Infrastructure Credit Act.

  • Notwithstanding anything herein to the contrary, the aggregate amount of Infrastructure Credits to be taken shall not exceed the aggregate amount of Company investment in Qualifying Infrastructure Improvements.

  • No such sale, lease, conveyance, grant or assignment shall relieve the County from the County’s obligations to provide Infrastructure Credits to the Operating Company or the Landlord, as the case may be, or any assignee of the same, under this Agreement as long as such assignee is qualified to receive the Infrastructure Credits under the Infrastructure Credit Act.

  • In no event shall the aggregate amount of Infrastructure Credits received as of any point in time exceed the amount of the Company’s aggregate investment in such eligible expenditures as of such time.

  • No such sale, lease, conveyance, grant or assignment shall relieve the County from the County’s obligations to provide Infrastructure Credits to the Company, or any assignee of the same, under this Agreement as long as such assignee is qualified to receive the Infrastructure Credits under the Infrastructure Credit Act and as long as the County’s consent is obtained in accordance with this Section 4.02.


More Definitions of Infrastructure Credits

Infrastructure Credits means the Special Source Revenue Credits pursuant to the Act and as set forth herein.
Infrastructure Credits means the annual special source revenue credits provided to the Company pursuant to Section 3.02 hereof.
Infrastructure Credits means the annual infrastructure credits provided to the Company pursuant to the MCIP Act and Section 4.2 hereof with respect to the Infrastructure and shall include Credit One and Credit Two, as applicable.
Infrastructure Credits means those credits against the fee in lieu of tax payments to be made by the Company to the County as authorized by Section 4-1-175 of the Code and Section 4.9 hereof.

Related to Infrastructure Credits

  • Infrastructure costs means such costs as are reasonably incurred for the acquisition and construction of infrastructure.

  • Infrastructure facility means a building; structure; or networks of buildings, structures, pipes, controls, and equipment, or portion thereof, that provide transportation, utilities, public education, or public safety services. Included are government office buildings; public schools; courthouses; jails; prisons; water treatment plants, distribution systems, and pumping stations; wastewater treatment plants, collection systems, and pumping stations; solid waste disposal plants, incinerators, landfills, and related facilities; public roads and streets; highways; public parking facilities; public transportation systems, terminals, and rolling stock; rail, air, and water port structures, terminals, and equipment.

  • Infrastructure Charge means a Water Infrastructure Charge or a Sewerage Infrastructure Charge;

  • Infrastructure means infrastructure serving the County and improved or unimproved real estate and personal property, including machinery and equipment, used in the operation of the Project, within the meaning of Section 4-29-68 of the Code.

  • IT Infrastructure means software and all computers and related equipment, including, as applicable, central processing units and other processors, controllers, modems, servers, communications and telecommunications equipment and other hardware and peripherals.
