Industrial track definition

Industrial track means a track or portion of track over which a railroad operates but which the railroad does not own or maintain either the rails, ties, or roadbed; or a track or portion of track which is devoted to the purpose of the user, either by lease or written agreement, in which case the lease or written agreement shall be considered as equivalent to ownership.
Industrial track shall have the meaning set forth in SECTION 2.02.
Industrial track means the railway track which is not the public property in common use and which is connected to the railway line, intended for the dispatch of items by means of railway vehicles for the legal person owner or possessor of the said track and on which the industrial railway may also perform the transport for own needs.
